PRIVACY DECLARATION


  
1. PURPOSE

1.1. The purpose of this Privacy Declaration is to inform Users (any person using the Plateform or the mobile applications or any other support made available by D4P) about the nature of the personal data collected and processed by D4P, as well as the purpose of such processing and the rights of Users with respect to the personal data collected.
1.2. This Declaration applies in addition to the terms and conditions and other documents included in the Contractual Documentation. In the event of any inconsistency between the terms and conditions and these terms and conditions, the terms and conditions shall prevail.
1.3. If the User does not agree with this Declaration, the User is requested not to use the D4P Service, including the various applications, and not to provide any personal data.

2. DATA COLLECTED

2.1. Information collected automatically. When you visit the Site, certain information about you is collected automatically (IP address, location, pages viewed on the Site, date and time of viewing, cookies, browser preference, operating system, access data, etc.). 2.2. Information provided voluntary by Users. The User may be asked to provide personal data to D4P. The data required to send a registration on the Platform and/or the mobile applications are in particular the email address, first name, last name and/or company name, address, GLN (Global Location Number) of the healthcare professional and telephone number. These data are mandatory, and their absence may make registration impossible. In addition to the required data, optional data can be provided voluntarily by the User. The data required for use (mandatory) are mentioned in the forms by the addition of an asterisk or the impossibility of validating the form without filling in the dedicated field.

2.3. Information concerning minors. Data concerning underage Users is only collected with the agreement of the holder of the parental authority. Any data that may be collected unintentionally is destroyed as soon as possible.

3. USE OF COLLECTED DATA

3.1. Automatically collected data. The data collected automatically allows D4P to analyze the behavior of Users on the Site, the Platform and the mobile applications, traffic and preferences, in particular in order to optimize and improve the quality of its Services.

3.2. Data provided by Users or third parties. D4P processes and uses the data necessary to fulfill its contractual obligations and to verify compliance with the terms of use. The processing of this data also allows us to provide personalized content to better meet the expectations of the User.

4. COMMUNICATION AND TRANSMISSION OF DATA

4.1. The User's personal data is not transmitted to third parties with the intention of using it for direct marketing purposes, unless the User authorizes otherwise.

4.2. The User's personal data may be passed on or communicated to third parties in the following cases: (i) for the purpose of executing the contract between the Customer and D4P. Data collected in the course of registration on the platform may also be used for the purpose of promoting similar or identical items that may be of interest to the User; (ii) in the course of providing services on behalf of D4P; (iii) where the User has consented to this; (iv) in joint promotions or programs with partners; (v) where required by law or where communication is reasonably necessary to enforce a court order or respond to a legal claim; (vi) in the event of a merger, acquisition of the company or parts of the company by another company.

4.3. D4P reserves the right to anonymize certain data in order to pass them on to third parties for research, statistical or marketing purposes.

5. USER’S RIGHTS

5.1. Right of access. The User may at any time request access to his/her personal data stored by D4P.

5.2. Right of rectification. The User whose data is inaccurate, or incomplete has the right to have it corrected.

5.3. Right of withdrawal and/or opposition. The User may at any time oppose the collection or processing of certain data concerning him/her (opting out). This objection may result in the termination of the provision of the D4P Service.

5.4. Right to deletion. The User has the right to request the deletion of personal data concerning him/her when their use is no longer necessary, or the User no longer agrees with the processing of his/her data. Such data will be deleted as soon as possible, unless otherwise provided by law.

6. SECURITY

6.1. D4P takes the protection of its Users' data very seriously and undertakes to treat their personal data confidentially and with the utmost care. In particular, D4P takes appropriate security measures to prevent unauthorized access, disclosure, alteration or destruction of collected data in accordance with Art. 7 of the Federal Data Protection Act (DPA), Art. 8-9 of the Ordinance on the Federal Data Protection Act (FDPA), the EU General Data Protection Regulation (GDPR) and any other applicable data protection regulations, insofar as these are applicable. However, D4P cannot guarantee complete and comprehensive protection of data against unauthorized processing due to the risks associated with the use of the internet and electronic means of communication.

7. DATA RETENTION

7.1. Data collected by D4P is kept for as long as the purpose for which it was collected requires, subject to legal provisions providing for longer data retention periods. After this period, the personal data is deleted.

8. MODIFICATIONS

8.1. D4P reserves the right to change its Declaration Policy at any time. Changes will be posted on the Site, the Platform and the mobile applications and will be effective as of the date of posting.

8.2. The Privacy Policy currently online is applicable. By continuing to browse the Site, the Platform and the mobile applications, the User accepts the current Privacy Policy.
